I. General Provisions
These Terms of Use govern your use of the "Sendica Pickup Points" application (the “Application”) made available through the Shopify App Store by the Service Provider.
By installing or using the Application, you agree to these Terms of Use and the associated Privacy Policy.
Definitions:
- Service Provider – Sendica OOD, a company registered in Bulgaria with VAT number BG205807569, located at Koloman Street 1, 1618 Sofia, Bulgaria.
- Service User – A person or business using the Application on their Shopify store.
- Application – A Shopify app that enhances shipping and pickup configurations.
- Agreement – The contract between the Service Provider and the Service User formed when the Application is installed.
- License – A non-exclusive, revocable, limited license to use the Application.
II. Scope of the Application
The Application adds functionality to your Shopify store by allowing you to configure courier pickup points and delivery methods.
Under this Agreement, the Service Provider:
- Provides access to the Application free of charge (for now).
- Offers technical support and regular updates.
- May request collaborator access to resolve issues, if necessary.
Using the Application constitutes acceptance of these Terms.
III. Technical Requirements
To use the Application, you must:
- Have an active Shopify store.
- Use a modern browser (e.g., Chrome) with JavaScript and cookies enabled.
- Be connected to the Internet.
The Service Provider does not guarantee correct operation if these conditions are not met.
IV. License and Termination
- The License is granted for the duration of the Agreement.
- You may uninstall the Application at any time.
- The Service Provider may terminate the Agreement or suspend access in case of abuse, breach of these Terms, or Shopify platform changes.
- We reserve the right to introduce fees in the future with at least 15 days' notice.
V. Limitation of Liability
No Warranty
The Application is provided “as is” and “as available” without warranty of any kind. The Service Provider does not guarantee error-free operation or compatibility with all devices or themes.
Limitation of Liability
To the maximum extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, consequential, or exemplary damages, including lost profits or business interruption.
Indemnification
The Service User agrees to indemnify and hold harmless the Service Provider from any claims, losses, or damages resulting from misuse, breach, or non-compliance with applicable laws.
VI. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Bulgaria. Any disputes shall be resolved by the competent courts in Sofia, Bulgaria.
VII. Changes
The Service Provider may update these Terms at any time. Updates will be communicated at least 15 days in advance. Continued use of the Application after the effective date constitutes acceptance.
